NORTH DITCH #23-01 View & Public Hearing Notice
Per the Ohio Revised Code (ORC) 940.20, you are hereby given notice that a petition has been filed at the Defiance Soil and Water Conservation District (SWCD) for the North Ditch #23-01. The requested project is for ditch construction/reconstruction. Proposed work to begin approximately 450' east of State Route 49, 1/2 mile north of Buckskin Road. Work from the above starting point west to State Route 49 to consist of ditch reconstruction, including areas of rip rap erosion control. Work to continue approximately 275' west of State Route 49. Work west of State Route 49 to consist of constructing a ditch to provide an outlet for surface water and for an existing 12" tile. All project work and the drainage area are included within Sections 3 & 4 of Hicksville Township, Defiance County, Ohio (see enclosed map).
The Board of Supervisors of the Defiance SWCD has preliminarily accepted this request for assistance on January 17, 2023 and in accordance with 940.19 ORC, has set a View and a Public Hearing concerning the reconstruction of this project.
The Board of Supervisors will conduct a View for the North Ditch #23-01. This View is scheduled for February 28, 2023 at 8:00 AM. The view will be held at Jacob North’s residence located at 7504 State Route 49, Hicksville, OH 43526.
The Board of Supervisors will also conduct a Public Hearing for the North Ditch #23-01. This hearing is scheduled for April 4, 2023 at 8:00 AM and will be held at the Hicksville Community Memorial Hospital in Community Room #2. The address is 208 North Columbus Street, Hicksville, OH 43526. At this hearing, the Supervisors will present the Preliminary Report and hear any comments or evidence offered by any landowner for or against the proposed improvement. The Preliminary Report will be available for download 1 week prior to the public hearing. Hard copies of the Preliminary Report may be requested by contacting the Defiance SWCD office.
As with all petition projects, all costs of engineering, construction, and future maintenance of the proposed improvement will be assessed to the benefitting parcels of land.
A landowner may file, not more than twenty-one (21) days after the date of the View, an amendment to the original petition that expands the length of the proposed improvement, provided that the amendment does not expand the area to be benefitted by the proposed improvement. Also, any landowner receiving this notice may comment on the proposed improvement in writing before or in person at the hearing on the petition. An amendment to the petition may be filed or written comments on the proposed improvement may be submitted to: Defiance SWCD, 06879 Evansport Road, Suite C, Defiance, Ohio 43512 or e-mailed to: mgray@defiancecounty.oh.gov. Please make specific reference to the “North Ditch #23-01” and list your parcel number(s) within the correspondence.
