Mud/Dry Creek #22-01 View & Public Hearing Notice
Per the Ohio Revised Code (ORC) 940.20, you are hereby given notice that a petition has been filed at the Defiance Soil and Water Conservation District (SWCD) for the Mud/Dry Creek #22-01 project. The requested project is for drainage improvements of Mud and Dry Creeks, predominantly through log jam and leaning tree removal. Proposed improvements on Mud Creek to begin at +/- 700 feet west of Coy Road (at confluence of Dry Creek) with work terminating at the outlet of Mud Creek into the Tiffin River near Evansport Road and Schick Road (+/- 10.6 miles). Proposed improvements on Dry Creek to begin at US Route 127, +/- 900 feet north of Huber Road, to its confluence with Mud Creek (+/- 1.0 mile). Proposed work to be performed in sections 1, 2, 3, 4, 5 & 6 of Delaware Township, sections 31 & 32 of Tiffin Township, and sections 32, 35 & 36 of Washington Township (see enclosed map).
The Joint Board of Supervisors of the Defiance and Williams Soil and Water Conservation Districts has preliminarily accepted this request for assistance on April 21, 2022 and in accordance with 940.19 ORC, has set a View and a Public Hearing concerning this drainage improvement project.
The Joint Board of Supervisors will conduct a View for the Mud/Dry Creek #22-01 project. This view is to inform landowners about the proposed improvement’s location and the drainage issues intended to be addressed by the proposed improvement. The view is scheduled for Wednesday, July 13, 2022 at 9:00 a.m. and will be conducted at the Sherwood VFW at 115 Cedar Street, Sherwood, Ohio 43556.
The Joint Board of Supervisors will also conduct a Public Hearing for the Mud/Dry Creek #22-01 project. This hearing is scheduled for Wednesday, October 5, 2022 at 9:00 a.m. and will also be conducted at the Sherwood VFW located at 115 Cedar Street, Sherwood, Ohio 43556. At this hearing, the Supervisors will present the Preliminary Report and hear any comments or evidence offered by any landowner for or against the proposed improvement. As with all petition projects, all costs of engineering, construction, and future maintenance of the proposed improvement will be assessed to the benefitting parcels of land. If you have received this letter, the parcel(s) that you own are within the project’s watershed (drainage area) and your land will be assessed if the project moves forward.
A landowner may file, not more than twenty-one (21) days after the date of the View, an amendment to the original petition that expands the length of the proposed improvement, provided that the amendment does not expand the area to be benefitted by the proposed improvement. Also, any landowner receiving this notice may comment on the proposed improvement in writing before or in person at the hearing on the petition. An amendment to the petition may be filed or written comments on the proposed improvement may be submitted to: Defiance SWCD, 06879 Evansport Road, Suite C, Defiance, Ohio 43512 or e-mailed to: jroehrig@defiancecounty.oh.gov.
